(HealthNewsDigest.com) – The Justice Department said it will file a petition Wednesday asking the Supreme Court to consider the constitutionality of the Obama administration’s health-care overhaul.
The department’s petition to the high court comes more than a month before its due date and further increases the chances that the justices will agree to consider the law during their coming term, which begins next week and runs through June 2012.
The department will ask the court to review an August decision from the Atlanta-based 11th U.S. Circuit Court of Appeals that struck down the law’s requirement that individuals carry health insurance or pay a penalty.
